1. Agreement to Terms

Welcome to PostBeacon ("we," "our," or "us"). By accessing or using postbeacon.co.za (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

PostBeacon is a social media management platform that allows users to schedule, publish, and analyze content across multiple social media networks. Our Service includes:

• Multi-platform post scheduling and automation
• Analytics and performance tracking
• Team collaboration tools
• AI-powered content assistance
• Account management features

3. Eligibility

You must be at least 18 years old to use PostBeacon. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 Account Creation

To use PostBeacon, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.2 Account Security

You agree to:

• Use a strong, unique password
• Enable two-factor authentication when available
• Not share your account with others
• Not use another person's account without permission

5. Subscription and Billing

5.1 Subscription Plans

PostBeacon offers various subscription tiers with different features and limitations. Current pricing and features are available at postbeacon.co.za/pricing.

5.2 Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• Prices are subject to change with 30 days' notice
• You authorize us to charge your payment method automatically

5.3 Free Trials

Free trial periods may be offered at our discretion. At the end of the trial, your subscription will automatically convert to a paid plan unless cancelled.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial subscription periods.

6. Acceptable Use Policy

6.1 Permitted Use

You may use PostBeacon only for lawful purposes and in accordance with these Terms.

6.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Post spam, malicious content, or misleading information
• Use the Service to harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Service except through our API
• Resell or redistribute the Service without authorization
• Post content that is illegal, defamatory, obscene, or discriminatory
• Violate the terms of service of connected social media platforms

6.3 Content Responsibility

You are solely responsible for all content you post through PostBeacon. We do not monitor or control user content and are not responsible for content posted by users.

7. Social Media Platform Integration

7.1 Third-Party Terms

When connecting social media accounts to PostBeacon, you remain subject to the terms and conditions of those platforms (Facebook, Instagram, Twitter/X, LinkedIn, TikTok, etc.).

7.2 API Changes

Social media platforms may change their APIs at any time. We are not liable for service interruptions caused by third-party API changes.

7.3 Account Credentials

You authorize PostBeacon to access your connected social media accounts using the credentials or tokens you provide.

8. Intellectual Property

8.1 Our Intellectual Property

PostBeacon, its logo, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain all rights to content you post through PostBeacon. By using the Service, you grant us a limited license to:

• Store, display, and transmit your content as necessary to provide the Service
• Use aggregated, anonymized data for analytics and service improvement

8.3 AI-Generated Content

Content generated using our AI features is provided to you for use, but we make no warranties about its originality, accuracy, or suitability for any purpose.

9. Data and Privacy

9.1 Data Collection

We collect and process data as described in our Privacy Policy, which is incorporated into these Terms by reference.

9.2 Data Security

We implement reasonable security measures to protect your data, but cannot guarantee absolute security.

9.3 Data Retention

We retain your data for as long as your account is active or as needed to provide services. Upon account deletion, we will delete or anonymize your data within 90 days, except where required to retain it by law.

10. Service Availability and Modifications

10.1 Service Uptime

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to PostBeacon. Scheduled maintenance will be announced in advance when possible.

10.2 Service Changes

We reserve the right to:

• Modify or discontinue features with reasonable notice
• Update these Terms (changes effective upon posting)
• Suspend accounts for Terms violations

11. Disclaimers and Limitations of Liability

11.1 "As Is" Service

POSTBEACON IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTBEACON SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount paid by you in the 12 months prior to the claim

11.3 Third-Party Platforms

We are not responsible for actions taken by third-party social media platforms, including account suspensions, content removals, or policy changes.

12. Indemnification

You agree to indemnify and hold PostBeacon harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post through the Service

13. Termination

13.1 By You

You may terminate your account at any time through your account settings or by contacting support.

13.2 By Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• Your account is inactive for 12+ months
• Required by law
• We discontinue the Service

13.3 Effect of Termination

Upon termination:

• Your right to use PostBeacon ceases immediately
• You remain liable for any outstanding fees
• We may delete your data after 90 days

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes shall be resolved in the courts of South Africa, and you consent to the jurisdiction of such courts.

14.3 Negotiation First

Before filing any legal action, you agree to attempt to resolve disputes through good-faith negotiation for 30 days.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PostBeacon.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

15.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
